Terms of Service

These Terms of Service govern your use of Safe Foundry, including our mobile app, web services, Safety Data Sheet upload tools, AI-assisted COSHH risk assessment features, subscriptions, credits, one-off purchases, support, and related services.
By creating an account, joining an organisation, uploading files, purchasing credits or one-off services, or using Safe Foundry, you agree to these Terms and our Privacy Policy.
About Safe Foundry
Safe Foundry helps organisations turn Safety Data Sheets into draft COSHH risk assessments and related documentation.
The Service is designed to support safety workflows, reduce manual administration, and help teams prepare consistent assessment records. It does not replace your legal duties, professional judgement, site-specific risk assessment, staff training, supervision, or compliance review.
Accounts and organisations
You must provide accurate account information and keep it up to date.
If you use Safe Foundry on behalf of an organisation, you confirm that you are authorised to do so. Organisation administrators may manage users, billing, credits, uploaded files, generated assessments, and organisation settings.
You are responsible for maintaining the security of your account and for activity that occurs through your account. Please contact us promptly if you believe your account has been compromised.
Your responsibilities
You are responsible for:
- ensuring that uploaded Safety Data Sheets and other materials are accurate, current, and lawful to use;
- reviewing all generated outputs before relying on them;
- adapting assessments to your workplace, substances, exposure routes, controls, procedures, and applicable laws;
- keeping appropriate records for your organisation;
- ensuring that only authorised users access your organisation’s account;
- using the Service in a lawful and responsible way.
You must not misuse the Service, attempt to bypass security or usage limits, upload malicious files, infringe third-party rights, reverse engineer the Service, or use the Service to create unlawful, unsafe, misleading, or harmful content.
AI-generated outputs
Safe Foundry uses automated systems, including AI, to extract information from uploaded documents and generate draft COSHH risk assessment content.
AI-generated outputs may contain mistakes, omissions, outdated information, formatting issues, or assumptions that are not appropriate for your workplace. You must check all outputs against the original Safety Data Sheet, your site conditions, applicable regulations, and competent safety advice before using or sharing them.
We do not guarantee that generated outputs will be complete, accurate, compliant, or suitable for your particular circumstances.
Uploaded content
You retain ownership of the files, data, and content you upload.
You grant us the rights needed to host, process, analyse, store, display, and transmit uploaded content so we can provide the Service, generate outputs, maintain security, troubleshoot issues, and improve the Service.
You must only upload content that you have the right to use and share through the Service.
Plans, credits, and billing
Some features require a paid subscription, credits, or both. Prices, credit allowances, billing periods, and included features are shown at the point of purchase or in the billing area of the Service.
Credits may be consumed when you submit an SDS for processing, generate outputs, export documents, or use other paid features. The app will indicate when an action consumes credits.
Subscription credits and top-up credits may have different rules, expiry periods, and refund treatment. Unless stated otherwise at purchase, used credits are not refundable.
Some features can also be bought as one-off purchases rather than through a subscription or credits — for example, a single risk assessment document, or a one-time AI fill of an assessment. One-off purchases grant a specific entitlement (such as creating one assessment, or one AI-assisted fill) rather than a credit balance. The price and what the purchase includes are shown at checkout.
Introductory or promotional prices may be subject to conditions shown at the point of purchase, such as being limited to one redemption per organisation.
Subscriptions and cancellation
Subscriptions renew automatically unless cancelled before the next billing date.
You can manage or cancel your subscription through the billing flow provided in the app or by contacting support. Cancellation stops future renewals but does not automatically refund amounts already paid, except where required by law or stated in a specific refund policy.
If a payment fails, we may suspend access to paid features until billing is resolved.
Refunds
Credits. If subscription credits or top-up credits have not been used, you may request a full refund within 14 days of purchase. Once credits have been used, they are non-refundable.
One-off purchases. When you buy a one-off digital service (such as a single assessment or an AI fill), you will be asked at checkout to expressly consent to immediate supply and to acknowledge that you lose your 14-day right to cancel under the Consumer Contracts Regulations 2013 once supply has begun. If you have not used the purchase, you may request a full refund within 14 days. Once the purchase has been used (for example, the assessment has been created or the AI fill has run), it is non-refundable.
Effect of refunds and payment disputes. If we issue a refund or a payment is reversed or disputed, we may cancel unused entitlements or credits associated with the payment, and we may restrict paid features for content associated with it — for example, disabling PDF export of an assessment whose purchase was refunded or charged back, while leaving the assessment viewable in your account.
Service availability and changes
We aim to keep Safe Foundry reliable, but we do not guarantee uninterrupted availability. The Service may be unavailable because of maintenance, updates, outages, third-party provider issues, security incidents, or events outside our reasonable control.
We may add, change, suspend, or remove features from time to time. Where a change materially affects paid access, we will take reasonable steps to notify affected users.
Third-party services
Safe Foundry may rely on third-party providers for hosting, payments, authentication, analytics, email, file processing, malware scanning, AI processing, storage, and support.
Your use of those connected services may also be subject to their terms and policies.
Intellectual property
We and our licensors own the Service, including software, design, branding, workflows, templates, and underlying technology.
You may use the Service only as allowed by these Terms. These Terms do not transfer ownership of our intellectual property to you.
Confidentiality and data protection
We handle personal data as described in our Privacy Policy.
You are responsible for ensuring that your organisation’s use of the Service complies with applicable data protection, employment, health and safety, and confidentiality obligations.
Do not upload information that you are not authorised to process through the Service.
Suspension and termination
We may suspend or terminate access if we reasonably believe that you or your organisation have:
- breached these Terms;
- misused the Service;
- failed to pay amounts due;
- created security, legal, or operational risk;
- used the Service in a way that may harm us, other users, or third parties.
You may stop using the Service at any time. Organisation administrators may remove users or close organisation access, subject to billing and retention requirements.
Disclaimers
The Service is provided on an “as is” and “as available” basis.
To the extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted availability, and compliance outcome.
Nothing in these Terms limits rights that cannot legally be limited, including statutory consumer rights where applicable.
Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, punitive, or exemplary losses, including loss of profits, revenue, business, goodwill, data, or anticipated savings.
We are not responsible for losses caused by your failure to review generated outputs, maintain safe working practices, use current SDS information, or comply with workplace safety obligations.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
Changes to these Terms
We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you, such as through the app or by requiring acceptance of the updated Terms.
Your continued use of the Service after updated Terms take effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws of England and Wales, unless mandatory laws in your location require otherwise.
